Welcome to Ondjango Bay
Ondjango Bay is an electronic marketplace that connects buyers and sellers. We provide the platform, payment processing, dispute resolution and trust services; the contracts for the goods or services you buy are between you and the seller, except where Ondjango Bay itself is the seller (e.g. first-party listings).
By using Ondjango Bay - whether you create an account, place an order, post a listing, or simply browse - you agree to these Terms & Conditions and to the policies they reference. If you do not agree, please do not use the platform.
About Ondjango Bay
Ondjango Bay is operated by ONDJANGO BAY, S.A., a public limited company organised under Angolan law, registered at Luanda, with NIF [to be confirmed at execution]. We are subject to Angolan law and supervised by the regulators competent for our activity, including the Banco Nacional de Angola (BNA) for payments, the Administração Geral Tributária (AGT) for tax, the Instituto Nacional de Defesa do Consumidor (INADEC) for consumer protection, and the Agência de Proteção de Dados (APD) for data protection.
Who can use Ondjango Bay
You can use Ondjango Bay if you are at least 18 years old (the age of majority under Angolan law). The platform is not intended for minors. If you are a legal entity, the person creating the account must have authority to bind that entity.
We accept users in five categories:
- Consumer Buyers - individuals buying for personal, family or household use.
- Business Buyers - entities buying for professional use, with valid NIF.
- Sellers - individuals or entities offering goods through Ondjango Bay, subject to additional Seller Terms .
- Registered Users - anyone who creates an account to use platform features.
- Visitors - anyone browsing the platform without an account.
Some platform areas may be restricted to specific user categories. We may refuse registration or limit functionality where required by law or by our risk-management policies (for example, sanctions screening under Lei n.º 5/20).
Your Account
To use most features you need an Ondjango Bay account. You agree to:
- Provide accurate, current and complete information at registration and keep it updated.
- Keep your password and authentication factors confidential. You are responsible for activity on your account.
- Enable two-factor authentication when prompted, especially for accounts with payment methods stored.
- Notify us immediately of any suspected unauthorised access by contacting security@ondjangobay.co.ao.
We may verify your identity at any time (KYC) and may suspend your account if verification fails or if we detect risk signals. Verification is required for sellers and for buyers exceeding certain transaction thresholds, in line with anti-money-laundering rules.
You can close your account at any time from /account/settings, subject to settlement of any pending obligations. We retain transaction records for the periods required by law (10 years for tax and AML/CFT records).
Buying on Ondjango Bay
When you place an order, you make an offer to the seller. The contract is formed when the seller accepts the order (typically automated). For most purchases, the seller is a third party; Ondjango Bay acts as the marketplace and is not the seller of the goods. For first-party listings (clearly labelled "Sold by Ondjango Bay"), we are the seller.
Prices shown include VAT where applicable. Shipping costs, customs duties, and any other charges are shown separately at checkout. Final price is confirmed at the order confirmation screen.
Your rights as a Buyer are detailed in the Buyer Terms and the Consumer Protection Information . These include the right to clear pre-contractual information, the right of withdrawal (14 days for distance contracts under Lei n.º 15/03), and the legal warranty for non-conforming goods.
Selling on Ondjango Bay
Sellers must register on the Seller Centre, complete identity verification, and accept the Seller Terms , which set out fees, listing rules, payout schedules, performance metrics, and tax obligations. Listings must be accurate, lawful, and comply with our Acceptable Use Policy and our intellectual property rules.
Ondjango Bay collects a commission on each completed sale and may charge other fees (advertising, premium placement, payment processing) as set out in the Seller Terms . We pay out sellers via the methods and on the schedule described in the Payment Terms .
Payments
We accept the payment methods listed in our Payment Terms , including Multicaixa Express (via EMIS), PayPal, Stripe and bank transfer. Some methods require strong customer authentication (SCA/3DS).
Transactions on Ondjango Bay are denominated in Angolan Kwanza (AOA) by default. Where another currency is supported, the platform displays the applicable exchange rate at the time of order. Payment processors may charge their own fees.
We do not store full payment card data on our servers. Card processing is handled by PCI-DSS-certified processors. We may retain tokenised references to allow you to repeat payments and to detect fraud.
Delivery and Shipping
Delivery is performed by the seller directly or by our logistics partners (including DHL Express for international shipments). Delivery times, costs and territories are described in the Shipping & Delivery Policy and shown at checkout for each order.
Risk of loss passes to the Buyer on delivery (or, for cross-border shipments, on customs release at the Buyer's address, except where another rule is mandatorily set by law for consumer sales).
Returns and Refunds
Consumer Buyers have a 14-day right of withdrawal for distance contracts under Lei n.º 15/03, with exceptions for personalised goods, perishables, hygiene-sensitive items, and sealed digital content already accessed. Other returns may be available under the seller's or platform's discretion. See the Refund & Return Policy for the procedure.
Approved refunds are processed to the original payment method within 14 days. Where the original method is unavailable, we may offer platform credit as an alternative.
Acceptable Use
You agree not to use Ondjango Bay for unlawful, fraudulent, harmful or abusive purposes. The full rules - including prohibited goods, prohibited conduct, content rules, intellectual property rules, and the protection of minors - are in the Acceptable Use Policy and the Community Guidelines . Violations may lead to content removal, account suspension or termination, payout retention, or referral to authorities.
Content You Post
You retain ownership of the content you post (listings, photos, reviews, messages). By posting, you grant Ondjango Bay a worldwide, royalty-free, non-exclusive licence to host, display, reproduce and distribute that content on the platform and in our promotional materials, for the duration of the posting plus a reasonable period for archive and dispute defence.
You are responsible for the legality of your content. You must not post content that infringes third-party rights, violates our policies, or is unlawful.
Intellectual Property
"Ondjango Bay", the Ondjango Bay logo, brand elements and platform software are our intellectual property or licensed to us. You may not use them without permission. Sellers' brands and listings belong to the sellers or their licensors. Our notice-and-takedown procedure for IP infringement is set out in the Intellectual Property Policy and the Copyright & Trademark Notice .
Our Role as Marketplace
Except for first-party listings, Ondjango Bay is not the seller of the goods or the provider of the services listed on the platform. We operate as an intermediary: we host listings, facilitate the conclusion of contracts between buyers and sellers, process payments, support delivery and provide dispute resolution. We do not warrant the quality, safety, legality or accuracy of seller listings, but we do enforce platform rules and remove non-compliant listings.
Our protection programmes - including the Buyer Protection Programme described in the Buyer Terms - apply to qualifying transactions on the platform.
Disclaimers and Limits of Liability
The platform is provided "as is" and "as available". We do not guarantee uninterrupted availability or that the platform is free of errors or vulnerabilities. We do guarantee compliance with our legal duties and our published service-level commitments. See the Disclaimer & Legal Notices for further detail.
To the maximum extent permitted by Angolan law, our liability for indirect, consequential or punitive damages is excluded, and our aggregate liability for direct damages arising from your use of the platform is limited to the greater of (i) the total commissions you paid to Ondjango Bay in the 12 months preceding the event, or (ii) AOA 500,000. These limits do not apply where the law prohibits limitation (in particular for death, personal injury, gross negligence or wilful misconduct, and mandatory consumer rights).
Suspension and Termination
We may suspend or terminate your account, with notice where reasonable, if you breach these T&Cs, our Acceptable Use Policy , or applicable law, or if we are required to do so by a competent authority. You may close your account at any time. Termination does not affect rights and obligations accrued before termination, nor does it release you from duties of confidentiality, payment, or compliance that by their nature survive.
Resolving Disputes
If you have a problem with a transaction, contact the seller first. If that does not resolve the matter, open a claim through our Dispute Resolution centre. Consumer Buyers also retain the right to file a complaint with INADEC and to pursue judicial action.
Business Buyers and Sellers may submit disputes with Ondjango Bay to mediation under Lei n.º 12/16 or, by agreement, to arbitration under Lei n.º 16/03 at the Centro de Arbitragem de Conflitos de Consumo or equivalent. Consumer Buyers retain access to the courts of their habitual residence under Lei n.º 15/03.
Changes to These Terms
We may update these T&Cs from time to time. Material changes are communicated to you at least 30 days in advance by email or in-app notification, with a summary of the changes and the effective date. By continuing to use the platform after the effective date, you accept the new version. If you do not accept, you may close your account before the effective date.

Governing Law and Jurisdiction
These T&Cs are governed by Angolan law. The competent courts of Luanda have jurisdiction, except where mandatory law of consumer protection grants exclusive jurisdiction to the courts of the consumer's habitual residence (in which case those courts have jurisdiction).
